Open Letter to U Win Mra

Open letter to: U Win Mra,

Addressing his statement as Permanent Representative and Alternate =
Chairman of the Delegation of the Union of Myanmar(sic), in the Third =
Committee of the Fifty-Second Session of the United Nations General =
Assembly on the Draft Resolution A/C.3/52/L.63 "Situation of Human =
Rights in Myanmar", New York, 24 November 1997.

U Win Mra begins with the assertion that "the draft ritualistically =
repeats many paragraphs of last year's resolution without taking into =
consideration the present realities in Myanmar".

I agree many things about the human rights situation in Burma are =
ritualistically repeated at the annual UNGA and other forums because the =
human rights situation in Burma is appalling, and is in fact getting =
worse.

So, until the generals address the grave human rights situation, they =
will continue to see those of us who are concerned about our people of =
Burma, make "ritualistic" pleadings on their behalf.  You too could join =
us if you were willing to tell the truth and give up your fancy job.

Your assertion that the allegations are unsubstantiated and based on =
information from dubious sources is churlish in the extreme.  Are you =
saying that all your fellow states are that gullible they can be so =
easily hoodwinked?

Progress is a subjective word, isn't it?  There were many who said =
because progress is happening in Indonesia, we'll keep quiet about the =
authoritarian rule, the human rights abuses, arbitrary detentions, =
disappearances, torture, etc.

Many know this is wrong and will not keep quiet about the same situation =
in Burma, for the sake of your implied economic progress.

Do you know how much Burmese people are suffering from the economic =
hardship at the moment?  A viss of pork costs 650 kyats and a pyi of =
rice costs 140 kyats.  Do you know or hear about that?  Many Burmese =
people are now trying to get use to eating one meal per day.  Many are =
eating just rice gruel.  What sort of economic progress is it?

People of Burma do understand our troubled ethnic nationalities past and =
that is why in 1990 we overwhelmingly voted for democratic rule.  We saw =
it as a political solution to the future, a Federal Union under =
democratic rule, with the National League for Democracy (NLD) in power.  =
Your bosses have forcibly been preventing Daw Aung San Suu Kyi from =
becoming the leader of Burma because she is married to a foreigner.  =
When U Ne Win, then President of the Socialist Republic of the Union of =
Burma, married Yadana Natme, a foreigner, you all applauded him.  What =
is the difference? =20

We admire, respect and want Daw Aung San Suu to be our leader not simply =
because she is the daughter of General Aung San but because of her =
qualification, sincerety and her commitment to the cause of democracy.  =
You know, I know and all people the world over know that she is the only =
person who can save Burma.  If you really love your country you must =
hand over power to the people who are the real owner of it.  As you are =
an Arakanese (Rakhine) origin you should know this. If you don't know =
you go back to Rangoon and jump down from the Thaketa bridge.

I know.  I was one of those people who stood for office and was elected. =
 I am a representative for the Mong Ping Constituency, leader of the =
Lahu National Development Party and stood ready to be in government with =
the NLD.  I and the majority of ethnic nationalities stand ready to do =
this.

The people made a pragmatic decision but you know and I know they stand =
ready to govern and be governed under democratic rule of the NLD and =
they too want you to step aside and honour the 1990 election result.

The military did not have the answer then - remember the party you =
supported, the National Unity Party (NUP - formerly BSPP) - won only 10 =
seats, whilst the NLD won 382 plus pro-democracy ethnic parties together =
won 75 seats.

The military mantra, you ritualistically repeat, is that 16 armed groups =
have returned to the legal fold.  You believe that if you say it enough =
times it willbecome reality.  It can't work because it is not predicated =
on even a grain of truth.

There is no legal fold to return to.  The generals' rule is unlawful at =
both domestic and international law.  (This is well documented and a =
matter of public record.)

The "armed groups" you refer to are the major ethnic nationalities =
people of Burma (32 % of the total population is ethnic).  They were =
worn down by the tatmadaw's brutality and you spend approximately half =
of the national treasure on the tatmadaw. =20

Since the SLORC now SPDC (basically same leopard with a few different =
spots) seized power the public expenditure on defence has sky rocketed.  =
The official defence expenditure figures for 1996-97 is 23.8 billion =
kyats, whilst 6.6 billion was spent on education and 2.3 billion on =
health.  The real defence expenditure is believed to be much higher, as =
an IMF report notes that "official estimates of military expenditure are =
believed to be underestimated as some spending, especially on military =
imports, takes place outside the hudget".  (Bertil Lintner - The Nation =
newspaper, Bangkok, August 4, 1997.)

The economic development U Win Mra mentions and that the ethnic =
nationalities peoples were promised and hoped for has been illusory.

Economic development in Burma is stifled and the economy has in fact =
collapsed.  The generals have done little to effect real economic change =
over the past decade.  Military dictatorships cannot create a climate =
conducive to business. =20

U Win Mra reiterates in his speech that "as a matter of policy, Myanmar =
does not condone human rights violations as it is committed to the =
principles enshrined in the Charter of the United Nations and the =
Universal Declaration of Human Rights".

The commitment is only with words - voiced at UN forums.  Those whose =
appalling human rights violations have not noticed the generals' =
commitment.

He then predictably says those who take the view that massive human =
rights violations happen in Burma, in this case the co-sponsors of the =
resolution, "lack a clear understanding of Myanmar's concept of human =
rights situation in Myanmar and its root causes".

Well.  I am not Western - I am from Burma, the Lahu people and I don't =
lack a clear understanding of Burma's concept of human rights and its =
root causes.  I stood for Parliament to unite with my fellow countrymen =
and women to work to safeguard their human rights, foster cooperation =
among the people, institute long overdue democratic reforms and to =
reduce the power of the state.

In short, the generals do not believe that anyone has any rights at all. =
 They believe it is OK to treat the people with utter contempt: to =
terrorize them, instill so much fear they don't complain, enslave them, =
relocate them, killing those who don't comply, rape them, jail them for =
peaceful political activity, torture them,... ignore the wishes of the =
majority of the population who freely chose their form of government.  =
This clearly breaches the UN Declaration of Human Rights.

The generals are locked in a time warp.  They still operate within a =
feudal patriarch paradigm.  They showed no faith in the people by =
rejecting the people's will of 1990.  It is time they moved on, instead =
of posturing to the region and the international community that they are =
firmly in control.

Look closely, U Win Mra, at Indonesia.

Thailand, the Republic of Korea and the Philippines should teach you =
that the people's march towards democracy is unstoppable.

U Ne Win who still rules from behind the throne has in recent times =
taken lessons from his old authoritarian military buddy Mr. Soeharto.  =
This is indeed ominous.  But Soeharto is no longer in power.

Universities were closed U Win Mra - whichever way you say it.  The =
cessation of classes you call suspension still has the effect of closing =
campuses. =20

Elected representatives were forced to resign and your assertion that =
"they were permitted to resign only at their request" is like a saying: =
he committed suicide with a gun pointed at his head by his murderer =
saying 'drink the poison or take the bullet'.

Your claim that Myanmar (sic) enjoys a sound and comprehensive legal =
system is patently wrong.  There is no comprehensive legal system in =
Burma.  It is a mixture of the old, the new (common law - Burmese =
Buddhist law - codes) and military orders, decrees, etc.  It is an =
incomplete jigzaw.

I will show you a few examples: =20

Ma Nang Kham, 13-year-old daughter of U Lu Htaw and Daw Nang Pat from =
Mong Ke village, Mong Tong township,  met with a patrol company while on =
her way to her home on May 13, 1997.  The soldier beasts abducted her =
into the jungle, gang-raped and murdered her later on the same day.  The =
beasts were from Mong Han army outpost, under the command of Infantry =
Division 277.  Similarly, another girl, Ma Aye, 12,  was gang-raped and =
beaten unconcisously by Private Thein Win, Hla Aung, Kyi Aye and Htun =
Myint of the LID 333 on November 28, 1997.

Two Lahu children from Mong Kae village were accused of stealing two =
gold rings and money, owned by the wife of Captain Aung San Oo of LID =
823, and were brutally tortured during interrogation by the soldier =
beasts on May 6, 1997.  Mar Mar Oo, 8, dautghter of U Kya Khet and Daw =
Na Taw, and Maung Kya Sheh, 12, son of U Ah Taw and Daw Na Htaw, were =
tortured and later held in police custody.  After three days of =
detention, the police told the Lahu elders about the fate of the two =
children and when their uncle Saya Kya Bo went to visit them, he too was =
arrested without any charges.  Only after the villagers raised 70,000 =
kyats and offered it to the police, the two children and their uncle =
were then released. =20

Could you, U Win Mra, take action against the responsible beasts?  As =
you claim in your speech that Myanmar (sic) enjoys a sound and =
comprehensive legal system you must be able to take action.  If you =
can't you are a big liar.

Operative paragraph 10 you say, U Win Mra, "represents a blatant =
interference in the intgernal affairs of Myanmar".  I do not accept your =
view; however even from your viewpoint you cannot accuse me of such =
interference. =20

Remember I am an elected representative of the people, ready to do my =
job when the generals finally cede power.

Remember I was a participant in the National Convention from 9 January =
1993 to 9 April 1994.  I know very well about the National Convention.  =
The generals have announced as if the National Convention is drafting a =
new democratic constitution.  But in reality the authoritarian =
constitution which guarantees the military a leading role in the future =
political life of Burma has already been drafted even before the =
National Convention started.  That's why I boycotted the sham National =
Convention soon after the fourth session ended, and NLD delegates =
followed suit the next year.  Most delegates from ceasefire groups are =
no longer attending, even though they have not declared publicly that =
they have boycotted the National Convention.

Yes, it is true that the military dictatorship ratified the UN =
Convention on the Rights of the Child, but you can't really expect to be =
taken seriously on this when children's morbidity and mortality is in =
decline...

So, U Win Mra, you have not managed to pull the wool over anyone's eyes =
with your lies and exhortations of innocence.

The Great Democracy Revolution will surely be triumphant soon!!!
