Interview of Mrs Marie Helene AUBERT
President of the Parliamentary Mission of information on the oil
companies

The French Mission relates to the oil companies role in the
international politics field and on their impact on social and
environmental issues. It is composed of three MPs: Mrs Marie Helene
AUBERT (Green party), Pierre BRANA (Socialist Party) and Roland BLUM
(Liberal Democracy, pro-european rifght-wing party).

What is the importance of Burma in your investigation ?
The burmese projects of a few companies, Total, Unocal and Premier Oil,
are of particular interest to us. It is important to understand that the
parliamentary Mission is not a court which would judge the companies
Total, Unocal and Premier oil ; the purpose of  this mission is to
collect as much  information as possible, concerning the projects of
these companies in Burma, and to assess their  credibility so as to
inform the Parliament and the French government.The French Constitution
does not enable us either to conduct foreign policy, nor to define the
marketing strategy of the oil companies. We will make proposals which
will try to bring solutions to the problems raised by the presence of
Western oil companies on the territories controlled by dictators. I also
want to underline the fact that we have to ??cope?? with a strong
polemic concerning the Total and Unocal Yadana Project in Burma, but one
too often forgets that Premier Oil, a British company, has built another

gas pipeline in this country. There is quite no British governmental
critics targeting this project, although strong campaigning has been
carried on this matter in Great Britain.

What could you tell us about your stay in Burma ?
We went to Burma within the framework of our mission. We went to Rangoon
and on the site of the pipeline ; we also stayed in Thailand. We had a
meeting with Mrs. Aung San Suu Kyi and two of the highest leaders of the
National League for Democracy in the French embassy. We also held
discussions with the SPDC Foreign Minister, U Win Aung, and with the

representatives of several French NGOs working with a lot of courage in
Burma. I would like to stress the importance of the meeting we had with
Aung San Suu Kyi: no french MP had been to Burma for the last fifteen
years. As we are trying ??to democratize?? the French foreign politics
process, it was also very significant to meet other members of
Parliament, elected in 1990, who are fighting for the restauration of
Democracy in a country where repression is absolute.

What did Daw Aung San Suu Kyi tell you ?
I can just summarize here the conversation which we had with her. First,
I must say she is greateful to the European Union for its diplomatic
stand, and for the actions taken during the last several years, to try
to bring the junta to dialogue with the oppoition so as to bring about
political opening. She asked us, precisely, " to show firmness, and not
to remain static" ; therefore to try and find new diplomatic solutions.

Does she think that the present political crisis will last a very long
time ?
She told us she thought the junta could collapse quickly because of its
contradictions, of  its incomptetence, and of the economic crisis. She
appeared relatively confident on this topic. In France, we are not so
convinced about that. But, after all, who had forseen the fall of the
Berlin Wall  ?


What broad lines of actions can the international community take ?
Mrs. Aung San Suu Kyi, the representatives of the government in exile
-NCGUB- and of the ethnic minorities we met in Thailand, are always
vigourosly opposed to foreign investment in Burma : as long as the
democracy is not restored, their message is that these investors are
playing into the hands of the junta. The burmese democrats are also
still very hostile to the development of the tourist industry.

What about the accusations of forced labour carried out against Total ?
It is established today that the burmese army resorted to forced labour
for various preliminary works on the building site of the gas pipeline,
built thereafter by Total. Some clearings of undergrowth and portering
was accomplished with forced labour before the Total personel began the
construction of the gas pipeline. Total representatives revealed that
when they were informed of these facts, they told the burmese army that
it should cease and so it would have ceased. The tatmadaw, however seems
to have continued to resort to forced labour for the construction of a
railway which is in the area. But the amalgam between these two building
sites can?t be made.


Do the exactions commited by the burmese army battalions in charge of
the security of the gas pipeline continue ?
We still need time to analyze all the documents and testimonys which we
collected. Several hearings had been devoted to Burma, in Paris, in the
weeks which preceded our journey and others hearings on Burma could take
place before we submit our final report, at the end of the month of
June. All the same, I want to take the opportunity which is given to me
refute the information given by the Bangkok Post, according to  which I
stated that it was not credible to say that Total and Unocal supported

financialy the burmese army to ensure the safety of the gas pipeline: we
collected various testimonys going in this sens.But, once again, we need
time to be able to say more: we will be positive only on topics which we
have been able to check with converging testimonys.

According to you, how is the SPDC going to use the money of the gas,
once the Thaïs start in buying it ?
It is the principal problem.The question of the distribution of the oil
revenue is a general difficulty which arises for all Western investments
in countries rulled by dictatorships. What can be done to be sure that
the incomes of oil and gas really benefit the populations, rather than
to buy always more weapons and to increase the private bank accounts of
the dictators? In this respect, We are following with the greatest
interest, a scheme which the World Bank tries to set up in Africa on
another pipe project, in Chad and Cameroun.

Can a solution be found to the problems arising from the engagement of
Total in Burma in an obligation of compliance with rules of good conduct
?

All the oil companies claim to respect codes of good conduct, but these
codes are not legaly binding. In any case, to pronounce ourselves on the
effective respect by Total, of its code of good conduct, we would need
to know the exact nature of the information produced in the lawsuit in
progress against the company Unocal. One says to us that Unocal defends
itself by accusing Total, but with which arguments exactly ? For the
moment, we  simply don?t know.

Finaly, were you abble to talk about the Interpol meeting held in
Rangoon at the end of February with your various interlocutors ?
The ambassador of France in Rangoon told us that the junta was begining
to use this congress to brush up its image. That is precisely why France
decided not to send its delegation.

Présidente de la Mission  d?information parlementaire sur les compagnies
pétrolières

La Mission porte sur le rôle des compagnies pétrolières dans la
politique internationale et son impact social et environnemental. Trois
députés la composent : Madame Marie Hélène AUBERT (Verts , Eure et
Loir), Pierre Brana (PS, Gironde) et Roland Blum (Démocratie libérale,
Bouches du Rhône).

Quelle place tient la Birmanie dans votre domaine d?investigation ?
Les projets birmans des compagnies Total, Unocal et Premier oil nous
intéressent tout particulièrement. Cependant, il est important de
comprendre que la Mission parlementaire n?est pas un tribunal qui
jugerait les compagnies Total, Unocal et Premier oil ; elle a pour but
de recueillir le plus d?informations possibles concernant les projets de
ces sociétés en Birmanie, de tenter de réunir les éléments qui
permettent d?estimer leur crédibilité et d?en informer le Parlement et
le gouvernement. La Constitution française ne nous permet pas non plus
de définir la politique extérieure de la France, ni la stratégie
commerciale des compagnies pétrolières. Nous ferons des propositions qui
tenteront d?apporter des solutions à tous les problèmes que pose la
présence des compagnies pétrolières occidentales sur les territoires

gouvernés par des dictateurs.

Je voudrais également souligner le fait que nous devons « gérer » une
polémique virulente à propos du projet Yadana de Total et Unocal en
Birmanie, mais l'on oublie trop souvent que Premier oil est une société
britannique qui a construit un autre gazoduc dans ce pays et le
gouvernement qui les laisse faire ne fait l?objet d?aucune critique,
même si des campagnes actives sont menées à ce sujet en Grande
Bretagne..

Comment s?est déroulé votre voyage en Birmanie ?
Nous nous sommes rendus dans le cadre de notre mission en Birmanie, à
Rangoon et sur le site du gazoduc de la société Total, comme en
Thaïlande. Nous avons pu rencontrer Mme Aung San Suu Kyi et deux des
plus hauts dirigeants de la Ligue nationale pour la démocratie, à
l?intérieur de l?ambassade de France. Nous avons également pu avoir des
discussions avec le Ministre des Affaires étrangères du SPDC, U Win
Aung, et avec les représentants de plusieurs ONG françaises qui
travaillent avec beaucoup de courage à l?intérieur du pays. Je voudrais
souligner l?importance de cette rencontre avec Mme Aung San Suu Kyi :
cela faisait 15 ans qu?aucun parlementaire français ne s?était rendu en
Birmanie. Il était également très important que, au moment précisément
où nous tentons de « démocratiser » la définition de la politique
étrangère de la France, que nous soyons parvenus à rencontrer d?autres
parlementaires, élus en 1990, qui se battent dans un pays où la
répression est absolue pour obtenir le retour de la démocratie.

Que vous a dit Daw Aung San Suu Kyi ?
Je ne peux que résumer ici la conversation que nous avons eue avec elle.
Tout à d?abord, elle est tout à fait reconnaissante aux pays de l?Union
européenne de l?action diplomatique qu?ils mènent, depuis plusieurs
années, pour tenter d?amener la junte au dialogue et à l?ouverture
politique. Elle nous demande, précisément, « de faire preuve de
fermeté,  et de ne pas rester statique » ; donc d?essayer de trouver de
nouvelles solutions diplomatiques.

Pense-t-elle que la crise politique actuelle va durer très longtemps ?
Elle nous a dit qu'elle pensait que la junte pouvait s'écrouler
rapidement du fait de ses contradictions, de son incomptétence, et de la
crise économique. Elle a paru relativement confiante sur ce point. En
France, nous avons du mal à en être convaincus, mais après tout, qui
avait vu venir la chute du mur de Berlin ?

Quelles peuvent être les grandes lignes d?action de la communauté
internationale?
Mme Aung San Suu Kyi, comme les représentants du gouvernement en exil
NCGUB et des minorités ethniques rencontrés en Thaïlande, sont toujours
aussi farouchement opposés aux investissements étrangers en Birmanie :
tant que la démocratie ne sera pas restaurée, leur message est qu?ils
font le jeu des adversaires de la démocratie. Les démocrates birmans
sont également toujours hostiles au développement du tourisme.

Qu?en est-il des accusations, de travail forcé entre autres,  portées
contre la société Total ?
Il est aujourd?hui avéré que l?armée birmane a recouru au travail forcé
pour différents travaux préparatoires au chantier du gazoduc, construit
par la suite par Total. Des travaux de débroussaillage, certaines

taches  de portage au cours du préchantier, ont été accomplis avec du
travail  forcé avant que les équipes de Total ne commencent la
construction du gazoduc. Les dirigeants de la société Total ont révélé
que lorsqu?ils  ont eu connaissance de ces faits, ils ont demandé à
l?armée birmane que  cela cesse et tout cela aurait alors cessé. La
tatmadaw aurait, par contre, continué à recourir au travail forcé pour
la  construction d?une voie ferrée qui se trouve dans la région.
Cependant,  l?amalgame peut difficilement être fait entre ces deux
chantiers.

Les exactions commises par les bataillons de l?armée birmane chargés de
la sécurité du gazoduc se poursuivent quant à elles ?
Nous avons encore besoin de temps pour prendre connaissance et analyser
tous les documents et témoignages que nous avons recueillis. Plusieurs
auditions avaient été consacrées à la Birmanie, à Paris, dans les
semaines qui ont précédé notre voyage et quelques autres sont encore
prévues avant que nous remettions notre rapport final, au mois de juin
prochain. Je veux, toutes fois, démentir ici avoir dit, comme l?a écrit
le Bangkok Post de Thaïlande, qu?il n?était pas crédible d'affirmer que
Total et Unocal soutenaient financièrement l?armée birmane pour assurer
la sécurité du gazoduc : nous avons recueilli différents témoignages
allant dans ce sens.Mais, encore une fois, nous avons besoin de temps
pour pouvoir en dire plus : nous n?affirmerons que ce que nous aurons pu
argumenter avec des témoignages se recoupant.

Selon vous, que va faire le SPDC de l?argent du gaz de Total, une fois
que les Thaïlandais seront en  mesure de l?acheter ?
C?est bien le principal problème. La question de la répartition de la
rente pétrolière est un problème général qui se  pose pour tous les
investissements occidentaux installés sur les territoires des
dictatures. Comment faire pour les  revenus du pétrole et du gaz
profitent vraiment aux populations, plutôt que de servir à acheter
toujours plus d?armes  et à augmenter les fortunes personnelles des
dictateurs ? Nous étudions par exemple, avec le plus grand intérêt, ce
que la Banque mondiale tente de mettre sur pied en Afrique sur un projet
d'oléooduc au Tchad et au Cameroun.

La solution aux problèmes posés par l'engagement de Total en Birmanie
peut elle passer par l'obligation  de respect de règles de bonne
conduite ?
Toutes les compagnies pétrolières prétendent respecter des codes de
bonne conduite, mais ces codes n'ont pas  force de loi. De toutes
façons, pour nous prononcer sur le respect effectif ou non, par Total,
de son code de conduite, il nous serait utile de connaître la nature
exacte des informations produites dans le procès américain en  cours,
contre la société Unocal. On nous dit que Unocal se défend en
incriminant Total, mais avec quels arguments  exactement ? Pour le
moment nous l'ignorons.

Pour finir, avez-vous pu évoquer avec vos différents interlocuteurs la
question du congrès d?Interpol tenu  à Rangoon à la fin de février ?
L?ambassadeur de France à Rangoon nous a dit que la junte commençait une
opération de récupération politique de ce congrès, au moment où la
France a justement décidé de ne pas y envoyer de délégation.
