Description: "Today, the Council imposed a seventh round of restrictive measures in view of the situation in Myanmar/Burma against six individuals and one entity in response to the continuing escalation of violence, grave human rights violations and threats to the peace, security and stability in Myanmar/Burma. The listings include three Union Ministers for immigration and population, labour and health and sports, two members of the State Administration Council (SAC), the Quartermaster General, as well as No. 2 Mining Enterprise (ME 2), a state-owned enterprise that is controlled by and generates revenue for the Myanmar Armed Forces (Tatmadaw). Restrictive measures currently apply to a total of 99 individuals and 19 entities. Those designated are subject to an asset freeze and a travel ban, which prevents them from entering or transiting through EU territory. In addition, EU persons and entities are prohibited to make funds available to those listed. Other EU restrictive measure remain in place: the embargo on arms and equipment and export restrictions on equipment for monitoring communications which might be used for internal repression, the export ban on dual-use goods for use by the military and border guard police, and the prohibition of military training and cooperation with the Tatmadaw. The restrictive measures come in addition to the withholding of EU financial assistance directly going to the government and the freezing of all EU assistance that may be seen as legitimising the junta. The EU remains deeply concerned by the continuing escalation of violence and the evolution towards a protracted conflict with regional implications. The Union condemns the continuing grave human rights violations including torture, sexual and gender-based violence, the persecution of civil society, human rights defenders and journalists, indiscriminate attacks on the civilian population, including a deadly airstrike killing at least 171 persons on 10 April 2023, by the Myanmar armed forces. The dissolution of 40 political parties on 28 March 2023 was another demonstration of the blatant disrespect by the military regime for democracy and the rights and wishes of the Myanmar population. All hostilities must stop immediately. The military authorities must fully respect international humanitarian law and put an end to the indiscriminate use of force. The relevant legal acts have been published in the Official Journal of the European Union. Background In February 2021, the Council adopted conclusions condemning in the strongest terms the military coup carried out in Myanmar/Burma. On 31 January 2023, the High Representative issued a declaration on behalf of the EU on the 2nd anniversary of the military take-over stating that, in the absence of any swift progress on the situation in Myanmar, the EU stood ready to adopt further restrictive measures against those directly responsible for and those abetting the undermining of democracy and the serious human rights violations in the country. The Council has imposed restrictive measures against those responsible for the military coup staged in Myanmar/Burma on 1 February 2021, and the subsequent military and police repression against peaceful demonstrators on 22 March, 19 April and 21 June 2021, 21 February and 8 November 2022, and 20 February 2023..."

Description: "The Council today decided to sanction 10 individuals and two military-controlled companies, Myanmar Economic Holdings Public Company Limited (MEHL) and Myanmar Economic Corporation Limited (MEC) in relation to the military coup staged in Myanmar/Burma on 1 February 2021, and the ensuing military and police repression against peaceful demonstrators. The decision was taken by written procedure. The individuals targeted by sanctions are all responsible for undermining democracy and the rule of law in Myanmar/Burma, and for repressive decisions and serious human rights violations. The two sanctioned entities are large conglomerates that operate in many sectors of Myanmar’s economy and are owned and controlled by the Myanmar Armed Forces (Tatmadaw), and provide revenue for it. The adopted sanctions specifically target the economic interests of Myanmar’s military regime, which is responsible for the overthrow of Burma’s democratically elected government. Sanctions are crafted in such a way to avoid undue harm to the people of Myanmar. Today’s decision is a sign of the EU’s unity and determination in condemning the brutal actions of the military junta, and aims at effecting change in the junta’s leadership. Today’s decision also sends a clear message to the military leadership: continuing on the current path will only bring further suffering and will never grant any legitimacy. Restrictive measures, which now apply to a total of 35 individuals and two companies, include a travel ban and an asset freeze. In addition, EU citizens and companies are forbidden from making funds available to the listed individuals and entities. Pre-existing EU restrictive measures also remain in place. These include an embargo on arms and equipment that can be used for internal repression, an export ban on dual-use goods for use by the military and border guard police, export restrictions on equipment for monitoring communications that could be used for internal repression, and a prohibition on military training for and military cooperation with the Tatmadaw. EU restrictive measures add to the withholding of financial assistance directly going to the government and the freezing of all assistance to government bodies that may be seen as legitimising the junta. The EU remains a steadfast supporter of Myanmar/Burma’s people and of the country’s democratic transition. As a tangible sign of this support, the European Commission has recently allocated a further EUR 9 million in emergency humanitarian aid to assist those in need. Since 1994, the EU has provided €287 million in humanitarian aid to Myanmar, with €20.5 million allocated in 2021 so far. The EU works with trusted and independent humanitarian partners to address the protection, food, nutrition and health needs of the most vulnerable people, particularly in Rakhine, Chin, Kachin and Shan states..."

Description: Since the so-called transition to democracy— a transition often misunderstood and much exaggerated— Myanmar has been the centre of a ?gold rush”, as businesses from Asia and the West hope to make money from what has been called the ?Asia?s last economic frontier”. The EU accounts for around 10% of foreign direct investment in Myanmar and is keen to raise that number with its planned Investment Protection Agreement (IPA), a wide-ranging agreement on trade that has been in-negotiation in recent years. Yet, it has raised considerable concerns from civil society groups about the lack of transparency in these negotiations, and the potential negative impacts of the treaty. In 2016, over 500 CSOs jointly wrote to the EU commissioner, Cecilia Malmström, expressing their frustration with a ?consultation process” run by consulting agency ?Development Solutions”— one that amounted to little more than a few ?workshops” in Yangon and a scant questionnaire. ??[O]ne key question is missing: the question whether we at all want an IPA”, the letter states..."

"The EU is willing to open a new chapter in its relations with Myanmar/Burma, building a lasting partnership," it added. The European Union began easing sanctions against Myanmar a year ago as the military, in power for decades, progressively ceded power to civilians and implemented wholesale reforms of the economy. Ministers noted, however, that there were "still significant challenges to be addressed", in particular an end to hostilities in Kachin State and improving the plight of the Rohingya people..."

Description: 1. The EU strongly condemns the brutal crack-down on demonstrators in Burma/Myanmar. It recalls its earlier declarations in which it urged the Burmese authorities to exercise restraint in the face of peaceful protests. The EU regrets that these calls have gone unheeded and regrets that arrests have continued over the recent days.
